Pontaro Terms of Service

These Terms of Service (the Terms) govern your use of Pontaro, a social competition service operated by SkillSwap LLC (Pontaro, we, us, or our). By creating an account or using Pontaro, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the service.

1. Who may use Pontaro

You must be at least 13 years old and legally permitted to use Pontaro where you live. If you are under 18, a parent or guardian must know that you are joining, and additional privacy and safety protections apply to your account. We may restrict access in locations where the service is not available.

You must provide accurate account information, keep your credentials secure, and promptly tell us through the support channel in the service if you believe your account has been compromised.

2. What Pontaro does

Pontaro lets people create challenges, agree on measurable rules, submit evidence, use AI-assisted verification, confirm results, participate in Circles, and appear on eligible leaderboards. Features may change as the service develops.

Pontaro does not place a challenge on anyone's behalf. A challenge becomes active only after the participants approve its rules and satisfy the requirements shown in the service.

3. Pontaro Credits and Points

Pontaro Credits are virtual items used only within Pontaro. Credits are not money or property, have no cash value, and cannot be withdrawn, sold, transferred outside Pontaro, or exchanged for money, cryptocurrency, gift cards, merchandise, or prizes.

Participants may commit Credits to an eligible challenge. When a result is confirmed or decided through the review process, Pontaro applies the agreed distribution to the virtual Credit ledger. If a challenge is cancelled, voided, tied, or cannot be completed, Credits are returned according to the agreed rules.

Points reflect verified participation and achievements. Points may affect rankings and may support in-app rewards, but they have no monetary value. Pontaro may correct Credit or Point balances to resolve errors, reverse abuse, or enforce these Terms. Material corrections are recorded in the service.

Purchasing Credits is not currently available. No payment method is required for ordinary play. Pontaro will update these Terms before introducing any purchase feature.

4. Creating and accepting challenges

Challenge rules must clearly identify the participants, objective, deadline, evidence requirements, Credit commitment, verification method, and result process. Review the full agreement before accepting it. Pontaro may reject a challenge that is unsafe, illegal, abusive, impossible to verify, or inconsistent with these Terms.

Do not participate in a challenge beyond your abilities or in unsafe conditions. Stop immediately if you feel unwell or unsafe. Pontaro does not provide medical, fitness, legal, or financial advice.

5. AI Witness and automated tools

AI Witness combines deterministic measurements, computer-vision tools, and, where configured, language-model assistance. These tools may identify uncertainty, missing evidence, or a recommended result. They are not infallible.

AI output does not silently override the agreed rules or make an irreversible final decision. Participants can review results, raise a dispute, and request human review where the service provides that option. When evidence is insufficient, Pontaro may leave the result unresolved or escalate it instead of declaring a winner.

6. Evidence and recordings

You may submit photos, videos, live-session recordings, statements, or other material required by a challenge. You must have the right to submit that material and must obtain permission from other people who appear in it where required.

Evidence is available only to authorized participants and Pontaro personnel who need access for verification, safety, support, or dispute review, except when you choose to share a result. Our Privacy Policy explains how evidence is processed, protected, and retained.

7. Mutual confirmation, disputes, and appeals

Ordinary settlement requires the confirmations described in the challenge agreement. Silence is not confirmation. If participants disagree, the related Credits remain held while the dispute is reviewed.

Reviewers may consider the agreed rules, submitted evidence, system measurements, participant statements, and relevant safety or integrity records. Decisions include a written reason where the service supports it. Appeals must be submitted within the period shown in the service and may be reviewed by a different authorized person.

8. Circles, community features, and leaderboards

Circles are member spaces with their own membership and activity. Invitation links and codes may be time-limited or revocable; protect them from unauthorized use. Circle content remains subject to these Terms.

Leaderboard rankings are for recognition within Pontaro. Rankings may change after corrected results, moderation decisions, or account actions. Teen accounts are hidden from global leaderboards by default.

9. Prohibited challenges and conduct

You may not use Pontaro to:

• create or promote illegal activity, violence, self-harm, dangerous stunts, drug or alcohol misuse, sexual content, coercion, harassment, bullying, or exploitation;
• threaten, shame, impersonate, deceive, or expose another person's private information;
• cheat, collude, edit or fabricate evidence, use another person's performance, manipulate results, farm Points, or operate multiple accounts to gain an advantage;
• interfere with the service, bypass security controls, scrape protected data, introduce malicious code, or use automated systems without permission; or
• infringe another person's intellectual-property, privacy, publicity, or other rights.

Private Circles do not create an exception to these rules.

10. Safety and teen protections

Adults must not use Pontaro to seek inappropriate contact with teens. Teen and adult accounts are separated in relevant discovery, social, challenge, and Circle features. We may restrict contact, preserve evidence, make legally required reports, or contact authorities when necessary to protect someone from harm.

11. Your content

You retain ownership of content you submit. You grant SkillSwap LLC a worldwide, non-exclusive, limited license to host, store, process, analyze, reproduce, and display that content as necessary to operate, secure, improve, and support Pontaro and to make it available to the people you choose.

This license ends when the content is deleted from our systems, except where continued retention is required for safety, disputes, legal obligations, backups, or enforcement of these Terms.

12. Pontaro intellectual property

Pontaro, AI Witness, our software, designs, branding, and service content are owned by SkillSwap LLC or its licensors and are protected by applicable law. These Terms do not grant you the right to copy, modify, reverse engineer, sell, or misuse them.

13. Account restrictions and termination

We may warn, restrict, suspend, or terminate an account that violates these Terms, threatens safety or service integrity, or must be restricted by law. We consider context and available evidence and do not impose a permanent ban solely because of an unverified automated classification.

You may request account deletion through the service. Virtual Credits and Points are forfeited when an account is permanently closed because they have no monetary value. Certain records may be retained as described in the Privacy Policy.

14. Service availability and changes

Pontaro is provided on an as available basis. We do not guarantee that the service, a particular verification method, or an external AI provider will always be available. We may add, remove, pause, or change features to improve safety, reliability, compliance, or the user experience.

15. Disclaimers

To the extent permitted by law, Pontaro is provided without warranties of uninterrupted operation, perfect accuracy, fitness for a particular purpose, or non-infringement. AI and computer-vision results can be incomplete or incorrect. You remain responsible for deciding whether a challenge is safe and appropriate.

Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

16. Limitation of liability

To the extent permitted by law, SkillSwap LLC and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages; loss of virtual Credits or Points; or harm caused by a challenge you voluntarily undertake. This limitation does not apply where the law does not allow it.

17. Privacy

Our Privacy Policy explains what information Pontaro collects, how it is used, when it is shared, how long it is retained, and the choices available to you.

18. Changes to these Terms

We may update these Terms. We will post the updated version and give additional notice when a change materially affects your rights or use of Pontaro. Where required, we will ask you to accept the revised Terms before continuing.
